The supermarket giant was fined 2,[link widoczny dla zalogowanych],000 at Dublin District Court after it pleaded guilty to four counts of sending mails to customers who had indicated that they did not wish to receive them.
Tesco Ireland has also undertaken to suspend all marketing emails until the situation is resolved to the satisfaction of the Office of the Data Protection Commissioner,[link widoczny dla zalogowanych], following the court case -- the first of its kind -- which took place yesterday.
The incidents happened in July and August of last year and Tesco admitted the offences when a representative appeared before a judge in the Richmond Courthouse,[link widoczny dla zalogowanych].
Deputy Data Protection Commissioner Gary Davis has said this was the first conviction of its kind secured by the office in relation to the sending of unsolicited marketing emails to customers,[link widoczny dla zalogowanych].
He said the case had been taken because the office had previously warned Tesco about the company's activity in this area,[link widoczny dla zalogowanych].
He said the office was very satisfied with the outcome of the case and hoped it sent a message to others marketing in this way,[link widoczny dla zalogowanych].
The offences were found to be contrary to the European Communities (Electronic Communications Networks and Services Data Protection and Privacy) Regulations,[link widoczny dla zalogowanych], 2003 as amended by the European Communities (Electronic Communications Networks and Services Data Protection and Privacy Amendment) Regulations 2008.
