American law has rocky newbie
A high level public agency funded by American tax dollars, you use a number of that money to support home-grown businesses and help create American jobs. It's a win-win-win, right?
When it comes to a year-old Minnesota law, the truth isn't so clear-cut, of the same quality intentions have run into thorny details.
The law says uniforms or protective gear bought by public agencies should be produced in the United States. Dave Tomassoni, DFL-Chisholm, the law's Senate sponsor.
"You run into this when you're passing laws," he said recently. "What the intent was,[link widoczny dla zalogowanych], why the balance was passed, who the balance is targeted at and whether or not you actually wind up putting what on the piece of paper that actually arrived on the scene the way you wanted it to."
He explained he'd be prepared to consider another look at the law,[link widoczny dla zalogowanych], for issues of clarity,[link widoczny dla zalogowanych], but insisted it will stick to the books.
In Plymouth,[link widoczny dla zalogowanych], cops have spent the year test-wearing a variety of American-made products for durability,[link widoczny dla zalogowanych], comfort and utility. But Chief Mike Goldstein said the department is not yet in compliance.
"No one is intentionally attempting to usurp exactly what the law is requesting, but until you will find products open to us, we must use things that meet our specifications, based on their deterioration and wearability and affordability and accessibility," he said. "So we're caught inside a quandary. . The statute's language now's city policy. But Police Lt. Duane Pike said the city has had a liberal interpretation of the law, which says agencies can use goods "manufactured outside of the United States if similar items are not manufactured or available to buy in the usa."
Based on Eagan's reading,[link widoczny dla zalogowanych], "similar" can apply to features including color, pocket configuration and value.
"A lot of the stuff, like clothing, it just isn't made here,[link widoczny dla zalogowanych]," Pike said. "We already did tests that included everything. We weren't looking for American- or foreign-made, and when we were pulling stuff together, we realized the majority of it's made from the country."
The statute doesn't show enforcement strategies or penalties. As the Department of Administration enforces what the law states for state agencies, it's up to cities and counties to police themselves, said Scott Kelly, staff attorney for that League of Minnesota Cities.
This past year,[link widoczny dla zalogowanych], Rep. Jenifer Loon,[link widoczny dla zalogowanych], R-Eden Prairie, gone to live in repeal the law in response to complaints that it amounts to an unfunded mandate at a time of economic stress for cities. "They're reducing employees and reducing jobs," she said,[link widoczny dla zalogowanych], "and we're telling them we know you can buy this T-shirt for $8 however, you need to buy the $25 version because it's state regulations. I did not think it had been right for the state to place that kind of mandate on local government."
That bill stalled,[link widoczny dla zalogowanych], but Loon said last week that they intends to introduce it again this year.
There have been successes,[link widoczny dla zalogowanych]. The Minnesota State Patrol is largely in compliance.
Lt. Jean Cemensky, the patrol's purchasing agent,[link widoczny dla zalogowanych], said she worried about the law's budgetary effect. vendors for nearly the entire uniform, which has some distinctive specifications (maroon, anyone?) that weren't among the mass-produced items made cheaply overseas.
The agency had simply to change its patch vendor,[link widoczny dla zalogowanych], from the Chinese company to one based in Florida. Plus, the patrol's hefty buying power, for around 565 uniformed employees, meant it might demand better pricing than it could for only several dozen,[link widoczny dla zalogowanych], she said.
"I don't think this can be a big a part of their budgets," he said. "But it is a point to be made, to create people think and lots of people are starting to think.
