The family of a Melbourne teenager killed by an unprovoked punch to the jaw say they are disappointed Australia's highest court has rejected an appeal against his killer's lenient sentence,[link widoczny dla zalogowanych].
The High Court on Friday refused an application to appeal against the reduced sentence given to the convicted killer,[link widoczny dla zalogowanych], also a teenager.
Cameron Lowe, 17,[link widoczny dla zalogowanych], fell to the ground and hit his head on the road after he was punched in the jaw in an unprovoked attack by another 17-year-old,[link widoczny dla zalogowanych], who cannot be identified,[link widoczny dla zalogowanych], in November 2010.
He regained consciousness and went home where he posted on Facebook that he was 'feeling sore' before going to bed,[link widoczny dla zalogowanych].
The next day,[link widoczny dla zalogowanych], he could not be woken and he died later in hospital.
His killer pleaded guilty to manslaughter over Cameron's death and to recklessly causing injury to another teenager he punched in similar circumstances just one week before the attack on Cameron,[link widoczny dla zalogowanych].
He was sentenced in the Victorian Supreme Court to six years' jail,[link widoczny dla zalogowanych], but his sentence was reduced by the Court of Appeal to three years in youth detention.
He was released in October this year by the Youth Parole Board, having served little more than a year.
Seeking special leave to appeal the Court of Appeal decision, crown prosecutor Gavin Silbert SC said the appeals court had erred in replacing the original sentence.
Mr Silbert told the full bench of the High Court in Melbourne on Friday that the original sentencing judge had balanced the offender's age with the principles of general deterrence and denunciation.
He told Justices Kenneth Hayne and John Heydon that the Court of Appeal had reduced consideration of such principles to zero,[link widoczny dla zalogowanych].
Cameron's mother,[link widoczny dla zalogowanych], Rikki Arney, cried as the application was rejected.
Outside court, she told reporters it made her sick that her son's killer was back on the streets.
'We only fight to stop other people from being in our shoes,[link widoczny dla zalogowanych],' she said.
