Adidas banned from selling kangaroo leather shoes,[link widoczny dla zalogowanych]
California does not allow products made from kangaroo hide to be removed or imported into the state,[link widoczny dla zalogowanych], even though they appear in near plague proportions in drought-ravaged Australia and also have to become culled.
Adidas had claimed the state regulations conflicted using the aims of the US Endangered Species Act,[link widoczny dla zalogowanych], which sought to support Australian efforts to control kangaroos.
"The final point here is they've decided the California law is constitutional,[link widoczny dla zalogowanych]," said Orly Degani,[link widoczny dla zalogowanych], an attorney for Viva! USA, a pet rights group that first filed a lawsuit in 2003 challenging the sale of kangaroo-skin shoes within the state.
"As of now,[link widoczny dla zalogowanych], it's illegal to market products made from kangaroos in California."
An attorney for that Humane Society of the United States, which filed a "friend from the court" brief with respect to plaintiffs Viva! USA,[link widoczny dla zalogowanych], called the court's decision "critically important" for species apart from just kangaroos - for example grizzly bears,[link widoczny dla zalogowanych], bald eagles and wolves, which are dependent on state protection.
"When the Federal Government decides to not protect a species,[link widoczny dla zalogowanych], the state can continue to achieve this,[link widoczny dla zalogowanych]," said HSUS counsel Jonathan Lovvorn,[link widoczny dla zalogowanych], explaining the ruling.
"What Adidas was saying was once the Authorities decides to not protect a species,[link widoczny dla zalogowanych], their state can't protect it either. Which was squarely rejected through the court."
A spokeswoman for Adidas wrote in an email that the company expects to ultimately prevail in the matter,[link widoczny dla zalogowanych], but didn't clarify further.
Other legal matters related to the case now is going to be delivered back to the appeals court.
Meanwhile, a bill that will overturn California's ban is working its way through the state legislature.
"Although Adidas makes some shoes using kangaroo leather, a typical practice in our industry,[link widoczny dla zalogowanych], Adidas does not make shoes from any endangered or threatened kangaroo species," said the Adidas spokeswoman Andrea Corso.
The Supreme Court's decision reversed a victory for defendants Adidas and retailers Sports Chalet and Offside Soccer this past year when they won their benefit of the lawsuit through Viva,[link widoczny dla zalogowanych]! USA.
